1. Who we are

Nikahsatu Service Optimizer ("the Service") is operated by Nikahsatu ([SSM_REG_NO]), of [ADDRESS], Malaysia ("we", "us"). By creating an account or using the Service you agree to these Terms on behalf of yourself and the organization you register.

2. What the Service does

The Service connects to the WhatsApp numbers your organization links to it, and both reads and sends messages on those numbers.

Reading. It analyzes the chats you choose to track, producing team-performance metrics (response times, SLA compliance, resolution rates) and AI-assisted analysis (categories, sentiment, satisfaction estimates, summaries).

Sending. Messages are sent from your connected numbers only as a result of an action you take or a feature you switch on: a reply you send from the Inbox; a call your systems make to our API; or the AI Agent, which — if you enable it — replies to your customers automatically and without a human reviewing each message first. You are responsible for what is sent from your numbers, including anything the AI Agent sends. You can switch the AI Agent off at any time, for the whole organization, for an individual number, or for a single chat.

3. WhatsApp — important disclaimers

  • The Service connects to WhatsApp using the linked-devices mechanism via third-party open-source tooling. It is not affiliated with, endorsed by, or certified by WhatsApp LLC or Meta.
  • Connecting a number this way may breach WhatsApp's Terms of Service and carries a risk of the number being restricted or banned by WhatsApp. You accept this risk entirely. We recommend using a dedicated number, not your primary business line.
  • You are responsible for keeping the primary phone active (WhatsApp requires it to come online periodically or linked sessions are disconnected).

4. Your responsibilities

  • Consent: you must have a lawful basis to process the group conversations you connect — including informing group participants (your staff and customers) that conversations are monitored for quality purposes, as required by the Personal Data Protection Act 2010 ("PDPA").
  • Account security: keep credentials confidential; you are responsible for activity under your account.
  • AI keys (BYOK): AI analysis runs on API keys you supply. You are responsible for those provider accounts, their costs, and complying with the provider's terms (e.g. DeepSeek, Anthropic).

5. Acceptable use

You must not use the Service to:

  • monitor conversations you have no lawful right to monitor;
  • harass, profile, or discriminate against individuals;
  • send spam or unsolicited messages (the Service does not send messages, and must not be combined with tooling that does so unlawfully);
  • attempt to breach, probe, or overload the Service's security or infrastructure;
  • resell or white-label the Service without our written agreement.

We may suspend accounts that violate this section.

6. Fees

The Service is provided to your organization under a separate written agreement. There is no self-serve billing in the Service itself.

7. Availability & support

The Service is provided "as is" without uptime guarantees. WhatsApp connectivity depends on third parties (WhatsApp, the open-source gateway) and may be interrupted by changes outside our control. We make reasonable efforts to restore service promptly.

8. Liability

To the maximum extent permitted by Malaysian law: our total liability for any claim is limited to the fees you paid in the 3 months before the claim; we are not liable for indirect or consequential losses, loss of profits, or losses arising from WhatsApp account restrictions/bans, third-party AI provider actions, or your failure to obtain required consents.

9. Termination

You may cancel at any time; data export is available on request before deletion. We may terminate for breach of these Terms with notice where practicable. On termination we delete your organization's data within 30 days, except records we must keep by law.

10. General

These Terms are governed by the laws of Malaysia; courts of Malaysia have exclusive jurisdiction. We may update these Terms with 14 days' notice via the dashboard or email. Questions: [SUPPORT_EMAIL].
